Zapid Terms and Conditions

Welcome to Zapid, a platform managed by Naganga HealthCare Private Limited with the main domain Zapid.in. These Terms and Conditions ("Terms") govern your access and use of our services, including the Zapid mobile app, website, and services available to users, vendors, and delivery partners.

By accessing or using our services, you agree to comply with these Terms. If you do not agree, please do not use our services.


General Terms (Applicable to All Users)

  1. Acceptance of Terms

    By using Zapid, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

  2. Eligibility

    You must be at least 18 years old to use our services. By using Zapid, you confirm that you meet this age requirement.

  3. Changes to Terms

    Zapid reserves the right to update or modify these Terms at any time. Changes will be posted on our website and app, and continued use of the services constitutes acceptance of the updated Terms.

  4. Termination

    Zapid reserves the right to terminate or suspend your access to the platform without prior notice for conduct that violates these Terms, is harmful to other users, or for other legitimate reasons.


Terms for Users (Customers)

  1. Account Registration

    Users must create an account to access services. You are responsible for maintaining the confidentiality of your login credentials and are responsible for all activities under your account.

  2. Service Availability

    Zapid provides various services, including but not limited to food delivery, grocery delivery, and parcel services. Availability of services and delivery times may vary depending on your location.

  3. Payment and Charges

    You agree to pay for all items ordered through Zapid, including delivery fees, handling charges, and applicable taxes. Payments can be made through the available payment methods on the app or website. Prices may change at any time without prior notice.

  4. Refund and Cancellation Policy

    Users may cancel orders within a limited time frame, subject to cancellation charges depending on the type of service and vendor policy. Refunds, if applicable, will be processed in accordance with the terms specified for each service category.

  5. Delivery Policy

    Zapid partners with third-party delivery agents for logistics. While we strive to deliver your orders within the estimated time, delays may occur due to traffic, weather, or other unforeseen circumstances. Zapid is not liable for any delays in delivery.

  6. User Conduct

    You agree to use the services responsibly and not engage in any activities that may harm Zapid, its users, vendors, or delivery partners. Misuse of the platform may result in the suspension of your account.


Terms for Vendors

  1. Vendor Registration and Approval

    Vendors must submit an application to become a registered seller on Zapid. Zapid reserves the right to accept or reject any application based on its discretion.

  2. Product Listings

    Vendors are responsible for accurately listing their products or services on the platform. Zapid is not liable for any discrepancies in product descriptions, pricing, or availability.

  3. Order Fulfillment

    Vendors must ensure that all orders are fulfilled in a timely manner. In case of delays, cancellations, or order rejections, vendors must inform the customer and Zapid immediately.

  4. Refunds and Cancellations

    Vendors must handle returns and refunds in accordance with their specified return policies. In case of disputes, Zapid will mediate but is not liable for any refunds not processed by the vendor.

  5. Vendor Conduct

    Vendors must comply with all applicable laws, regulations, and Zapid policies. Failure to meet these requirements may result in removal from the platform.


Terms for Delivery Partners

  1. Delivery Partner Registration

    To become a delivery partner, individuals must meet the eligibility requirements, including possessing a valid driver’s license, vehicle registration, and insurance (if applicable). All delivery partners must pass the onboarding process managed by Zapid.

  2. Delivery Responsibilities

    Delivery partners must ensure the safe and timely delivery of orders. Any loss or damage during delivery will be the responsibility of the delivery partner, and Zapid may deduct penalties for any such incidents.

  3. Conduct and Professionalism

    Delivery partners are expected to behave professionally and respectfully while interacting with vendors and customers. Any reports of misconduct may result in suspension or termination of the delivery partner’s account.

  4. Insurance and Liability

    Delivery partners are responsible for their own insurance, including vehicle and personal liability insurance. Zapid will not be liable for any accidents, injuries, or damages caused during the course of delivery.

  5. Termination

    Zapid reserves the right to terminate a delivery partner’s account for failure to comply with these Terms, poor service, or for any other legitimate reason.


Liability and Disclaimers

  1. Limitation of Liability

    Zapid shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services.

  2. Third-Party Services

    Our platform may include links or integrations to third-party services. Zapid is not responsible for the content, terms, or privacy practices of third-party services.

  3. Indemnification

    Users, vendors, and delivery partners agree to indemnify and hold Zapid harmless from any claims, liabilities, damages, and expenses arising from the use of our services.


Governing Law and Dispute Resolution

  1. Governing Law

    These Terms are governed by the laws of India. Any disputes arising under these Terms will be subject to the jurisdiction of courts in Bengaluru, India.

  2. Dispute Resolution

    Any dispute between a user, vendor, delivery partner, and Zapid shall first be attempted to be resolved through good-faith negotiations. If unresolved, the dispute will be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.
